Emma has been instrumental in the re-establishing and developing of the Family Law Practice at ISOLAS. She provides specialist legal advice on all family matters including matrimonial, divorce, children and financial issues. She has extensive experience in this field, ranging from non-contentious divorces to high value financial agreements (pre-nuptials) involving substantial assets in various jurisdictions, as well as divorces involving negotiations and settling the division of substantial matrimonial assets in multi-jurisdictions. Practice is focused on Family and Matrimonial, together with Civil and Commercial litigation.
Emma’s clients praise her ‘big picture’ approach to her clients’ needs working to achieve the best possible outcomes. She always considers the best way to approach each case, depending on the client’s requirements and offers a bespoke service to her clients. She is able to understand the sensitive nature of family law matters and tries to deal with matters in a non-confrontational manner. However, her experience in civil litigation, allied to her command of family and matrimonial law equips her well the necessary expertise required when dealing with more confrontational matters. Emma has substantial litigation experience within the area of financial mis-selling, having acted for both Banks and individuals in the past.
Current
Emma is currently assisting clients in the organisation and determination of financial circumstances by drafting and negotiating complex financial agreements between parties in the family and matrimonial context, often involving various high value assets in several jurisdictions. She is also drafting contact and maintenance agreements, involving parties who have now separated.
She has recently instructed Counsel in England in the context of an application for a client in the English Courts under Schedule 1 of the Children Act and is also dealing with another set of UK solicitors on a separate matter, where the parties are involved in divorce proceedings in England and Emma is assisting in the transfer of Pension funds into Gibraltar.
Emma was also recently involved in an application for a consent order to be set aside on the basis of material non-disclosure. This case was heard just after the Judgments of the landmark cases of Gohil v Gohil and Sharland v Sharland were handed down, and the parties were able to settle on this basis.
Outside of Family law, Emma is currently leading in a very high value financial mis-selling claim acting for an individual. She also deals with insolvency work and is currently acting for a Swiss company, amongst others
